NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF FATE WILL HOLD A REGULAR CITY COUNCIL MEETING AT 6:00 P.M. ON MONDAY, OCTOBER 19, 2020 AT FATE CITY HALL, 1900 CD BOREN PARKWAY, FATE, TEXAS, FOR THE FOLLOWING PURPOSES:

1.

CALL TO ORDER AND CONFIRM A QUORUM

INVOCATION AND PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS

PRESENTATIONS

A.

Presentation of Proclamation to Ian Fields in honor of his dedicated service to the City of Fate

B.

Rockwall County Commissioner David Magness - Rockwall County Open Space Plan and appeal for stormwater corridors protection.

4.

PUBLIC COMMENT

This is an opportunity for the public to address the council on any matter, except public hearings that are included on the agenda. Comments related to public hearings will be heard when the specific hearing begins. Public comments are limited to three (3) minutes per speaker, unless otherwise required by law. To address the governing body, each speaker must complete a Public Comment Form and present the completed form to the City Secretary prior to the start of the meeting. Each speaker shall approach the podium and state his/her name and address before speaking. Speakers shall address the governing body with civility that is conducive to appropriate public discussion. Speakers can address only the governing body and not individual city officials or employees. The public cannot speak from the gallery but only from the podium. Per the Texas Open Meetings Act, the governing body is not permitted to take action on or discuss any item not listed on the agenda. The council may: (1) make a statement of fact regarding the item; (2) make a recitation of existing policy regarding the item; or (3) propose the item be placed on a future agenda.

CONSENT AGENDA

A.

Approval of Investment report for quarter ending September 30, 2020.

B.

approval of Resolution No. R-2020-086- adopting and supporting the Rockwall County Open Space Plan in concept.

C.

Approval of Resolution No. R-2020-087- approving the submission of a grant application to Texas Parks and Wildlife for the Local Park and Recreation Outdoor Grant Program for the Old Downtown Park; designating the City Manager as the City’s authorized representative; and providing an effective date.

D.

Approval of Resolution No. R-2020-088- approving the submission of a grant application to Texas Parks and Wildlife for the small community grant program for the park adjacent to Harry Herndon Elementary School; designating the City Manager as the City’s authorized representative; and providing an effective date.

E.

Approval of Resolution No. R-2020-089- accepting the resignation of Council Member Ian Fields, Place 3 and providing an effective date.

F.

Approval of Resolution No. R-2020-090- Ratifying The Settlement Of City Of Fate V. Glen Eskew, Jr. - Cause No. 1-18-1598, In The 439th Judicial District Court Of Rockwall County, Texas; And Providing For An Effective Date.

ACTION ITEMS/PUBLIC HEARINGS

A.

Discuss, consider, and take any necessary action regarding Resolution No. R-2020-091- appointing initial members to the Comprehensive Plan Advisory Committee.

B.

Williamsburg East Public Improvement District Related Items:

1.

Conduct a public hearing and consider the adoption of Ordinance No. O-2020-029- accepting and approving a service and assessment plan and assessment rolls for the Williamsburg East Public Improvement District, levying special assessments against certain property in the District and making certain findings and determinations relating to the District.

2.

Conduct a public hearing and consider the adoption of Ordinance No. O-2020-030- accepting and approving an operations and maintenance service and assessment plan and operations and maintenance assessment roll for the Williamsburg East Public Improvement District, levying operations and maintenance assessments against certain property in the District and making certain findings and determinations relating to the District.

3.

Discuss, consider, and take any necessary action regarding Resolution No. R-2020-092- approving an interlocal agreement with rockwall county appraisal district for the collection of the williamsburg east public improvement district assessments; authorizing the city manager to execute the agreement; and providing an effective date.

4.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2020-031- approving the issuance and sale of "City of Fate, Texas, Special Assessment Revenue Bonds, Series 2020 (Williamsburg East Public Improvement District Improvement Area #1 Project)" and approving various documents related to such bonds.

5.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2020-032- approving the issuance and sale of "City of Fate, Texas, Special Assessment Revenue Bonds, Series 2020 (Williamsburg East Public Improvement District Major Improvement Area Project)" and approving various documents related to such bonds.

C.

(This Application Is Associated With The Fate Villages Apartment Development Situated West Of Williamsburg Pkwy.) Discuss, Consider, And Take Any Necessary Action Regarding An Application Submitted By Alan Bain And Brian Carrington To Replat Lot 1, Block 1 Of The Fate South Elevated Storage Tank Addition And Adding A 16.8-Acre Portion Of Two Un-Platted Tracts To Create 2 Lots Totaling 18.35-Acres. The Area That Is The Subject Of This Replat Application Is Located West Of Williamsburg Parkway And South Of Water Tower Rd, Rockwall CAD Property ID’s 10519, 72207, And 89278. Case RP-20-002.

(This Application Is Associated With A Previously Approved Preliminary Plat And It Seeks To Amend The Lot Layout To Add Approximately 11-Lots. It’s Located West Of The C.D. Boren Pkwy And N Ben Payne Rd. Intersection.) Discuss, Consider, And Take Any Necessary Action Regarding Approval Of A Preliminary Plat For 204 Residential Lots In The Woodcreek Subdivision, Phases 8A And 8D, Containing 81.858 Acres Located In The R.B. Irvine Survey, Abstract No. 120, City Of Fate, Rockwall County, Texas. Applicant: The Fate 160 Investment Land LLC. Case #PP-20-006.

E.

Discuss, consider, and take any necessary action regarding Resolution No. R-2020-094- adopting an update to the City of Fate Master Thoroughfare Plan.

F.

Water, Wastewater, and Roadway Impact Fees related items:

1.

Conduct a public hearing to consider the amendment of land use assumptions and a capital improvements plan and the imposition of increased water and roadway impact fees and decreased sewer impact fees.

2.

Discuss, consider, and take any necessary action regarding Resolution No. R-2020-095- approving Water, Wastewater, and Roadway Impact Fee Studies and providing an effective date.

3.

Discuss, consider, and take any necessary action on direction to City staff on proposed new impact fee collection rates.

G.

Discuss, consider, and take any necessary action regarding Resolution No. R-2020-096- approving a Standard Utility Agreement with the Texas Department of Transportation (TxDOT) for the relocation and reimbursement of City-owned water facilities in conflict with the IH-30 expansion project; Authorizing the City Manager to execute said agreement and providing an effective date.

H.

Discuss, consider, and take any necessary action regarding the Fiscal Year 2021 Road Maintenance Plan.

I.

Discuss, consider, and take any necessary action regarding cancelling the November 2, 2020 Regular City Council Meeting.

J.

Discuss, consider, and take any necessary action regarding the Fate Christmas Tree Lighting.

MAYOR, COUNCIL, AND CITY MANAGER REPORTS

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Fate reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code for the following purposes:
