NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF FATE WILL HOLD A REGULAR CITY COUNCIL MEETING AT 6:00 P.M. ON MONDAY, OCTOBER 15, 2018 AT FATE CITY HALL, 1900 CD BOREN PARKWAY, FATE, TEXAS, FOR THE FOLLOWING PURPOSES:

CITIZEN COMMENTS

This item provides the opportunity for citizens to address the City Council on any matter whether or not it’s posted on the agenda. However, in accordance with the Texas Open Meetings Act, Section 551.041, the Council cannot discuss, deliberate, or take action on matters not listed on the agenda. At this time the Council will receive citizen comments, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City’s Public Meeting Procedures, comments will be limited to three (3) minutes and the City Secretary is directed to use a timer for such purposes.

Approval of minutes of the Council Meeting held October 1, 2018.

B.

Approval of Resolution No. R-2018-079- Reviewing And Adopting The City Of Fate Purchasing Policy, Repealing Resolution No. R-261 And Providing An Effective Date.

C.

Approval of the purchase of 20 Self Contained Breathing Apparatus (SCBA) for Firefighting/Hazardous Environments, 40 new cylinders, and an update to the breathing air compressor system in an amount not to exceed $197,625.75.

D.

Approval Of Quarterly Investment Report For The Quarter Ended September 30, 2018.

Approval of Resolution No. R-2018-080- Authorizing A Interlocal Cooperation Agreement Between The City Of Fate, Texas And The Rockwall Independent School District For Governmental Services Relating To A School Resource Officer Program; Authorizing The City Manager To Execute Said Agreement And Providing An Effective Date.

F.

Approval of Resolution No. R-2018-081- Authorizing A Interlocal Agreement Between Rockwall County And The City Of Fate, Texas For Fire Protection Services; Authorizing The Mayor To Execute Said Agreement And Providing An Effective Date.

A.

Discuss, consider, and take any necessary action regarding appointing members to the Charter Commission, Issuing the Commissions Charge, and providing an effective date.

(1)  Interview Candidates For Non-Council Class Members; (2) Accept Nominations for Non-Council Class Members (3) Accept Nominations for Council Class Members; (4) Discuss, Consider, And Take Any Necessary Action Regarding Resolution No. R-2018-082- appointing members to the Charter Commission, Issuing the Commissions Charge and providing an effective date.

Discuss, consider, and take any necessary action regarding Resolution No. R-2018-083- Adopting Updated Park And Recreation Improvements Plan And Updated Valuation For Parkland Acreage; And Providing An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2018-057- Updating The Park Development Fee Based On The Updated Park And Recreation Improvements Plan; And Providing For Severability And An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2018-058- Amending Chapter 18 “Miscellaneous Offenses”, Article III “Sex Offenders”, Section 18-2 “Sex Offender Map”; Providing For Savings, Severability, And Repealer Clauses; Providing For Publication; And Providing An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2018-059- Amending Section 22-81 (Definitions) And Section 22-82 (Permit Required, Exemptions) Both Of Article IV (Special Events) Of Chapter 22 (Parks And Recreation) Of The City Of Fate Code Of Ordinances; Providing For A Savings And Severability Clause; Providing For A Repealer Clause; Providing For A Penalty Of A Fine Not To Exceed The Sum Of Two Thousand ($2000.00) Dollars; And Providing For An Effective Date.

F.

Discuss, consider, and take any necessary action regarding a concept for reducing trash service requirements for rural parcels over 10 acres in size with long private drives.

G.

Discuss, consider, and take any necessary action regarding the presentation of Fate historical items.

H.

Discuss, consider, and take any necessary action regarding setting a time for an economic development workshop with Jason Claunch from Catalyst.

MAYOR, COUNCIL, AND CITY MANAGER REPORTS

Regarding items of Community Interest – Pursuant to Texas Government Code Section 551.0415 the Mayor, Council and City Manager may report on the following items:  (1) expression of thanks, congratulations or condolences; (2) information about holiday schedules; (3) recognition of individuals; (4) reminders about upcoming City Council events; (5) information about community events; (6) announcements involving imminent threat to public health and safety.

EXECUTIVE SESSION: In accordance with Texas Government Code, Section 551.001, et seq., the City Council will recess into Executive Session (closed meeting) to discuss the following:

A.

In accordance with Texas Government Code, Section 551.071, consultation with attorney on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act:

1.

To receive legal advice regarding a Development Agreement with DR Horton concerning Williamsburg Parkway

2.

To receive legal advice regarding a potential claim by The City of Fate as Assignee of LEMCO Construction Services L.P. and LEMCO Construction, LLC v. PCL Bonding Agency

B.

In accordance with Texas Government Code, Section 551.087, to discuss or deliberate regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City of Fate and with which the City is conducting economic development negotiations; and to deliberate the offer of a financial or other incentive to the business prospect:

RECONVENE INTO REGULAR SESSION: In accordance with Texas Government Code, Chapter 551, the City Council will reconvene into Regular Session to consider action, if any, on matters discussed in Executive Session

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Fate reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code for the following purposes:
