NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF FATE WILL HOLD A REGULAR CITY COUNCIL MEETING AT 6:00 P.M. ON MONDAY, JUNE 3, 2019 AT FATE CITY HALL, 1900 CD BOREN PARKWAY, FATE, TEXAS, FOR THE FOLLOWING PURPOSES:

NOTICE OF ATTENDANCE: NOTICE is hereby given that the Parks and Recreation Advisory Board may be in attendance at the City Council Meeting JUNE 3, 2019 being held at the Fate City Hall, 1900 CD Boren Parkway, Fate, Texas.

CITIZEN COMMENTS

This item provides the opportunity for citizens to address the City Council on any matter whether or not it’s posted on the agenda. However, in accordance with the Texas Open Meetings Act, Section 551.041, the Council cannot discuss, deliberate, or take action on matters not listed on the agenda. At this time the Council will receive citizen comments, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City’s Public Meeting Procedures, comments will be limited to three (3) minutes and the City Secretary is directed to use a timer for such purposes.

CONSENT AGENDA

Approval of minutes of the Council Meeting held May 20, 2019.

Approval of Resolution No. R-2019-031- amending the City's Appointment Policy providing for applicant interviews and appointments, for non-mid-term appointments, to take place on or before the first City Council meeting in July; and providing an effective date.

Discuss, consider, and take any necessary action regarding changing the Code of Ethics to Code of Conduct and include a provision on attendance, as recommended by the 2018 Charter Commission.

B.

Discuss, consider, and take any necessary action regarding Resolution No. R-2019-032- Approving An Agreement With Tristem, Ltd. For An Audit Of Utility Franchise Fee Payments And Payment Of A 35% Fee For Reimbursements Received From Utility Providers; Authorizing The City Manager To Execute The Agreement; And Providing An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2019-018- Amending Appendix A, Fee Schedule, Article II, Section 2.3 – Building Permit Fees Of The Code OF Ordinances Of The City To Remove Consideration Of Value Of Residential Dwelling And To Remove Consideration Of Cost Of Construction Or Improving Of Residential Dwelling Related To Building Permit And Inspection Fees; Adopting Building Permit Fees Based On The Square Footage Of The Structure; Providing For A Savings/Repealing Clause; Providing A Severability Clause; Providing For Publication And Providing An Effective Date.

Discuss, consider, and take any necessary action regarding Ordinance No. O-2019-019- amending Chapter 2 “Administration,” Article I “In General,” Section 2-2 “City Seal” of the Code of Ordinances of the City of Fate, Texas to adopt a new official seal of the City.

E.

Discuss, consider, and take any necessary action regarding cancelling one of the Regular City Council Meetings scheduled for July 2019.

Regarding items of Community Interest – Pursuant to Texas Government Code Section 551.0415 the Mayor, Council and City Manager may report on the following items:  (1) expression of thanks, congratulations or condolences; (2) information about holiday schedules; (3) recognition of individuals; (4) reminders about upcoming City Council events; (5) information about community events; (6) announcements involving imminent threat to public health and safety.

EXECUTIVE SESSION: In accordance with Texas Government Code, Section 551.001, et seq., the City Council will recess into Executive Session (closed meeting) to discuss the following:

In accordance with Texas Government Code, Section 551.071, consultation with attorney on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act:

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Fate reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code for the following purposes:
