Code Violation Definition

What is a Code Violation?


A code violation includes any of the following:
  • High Grass and Weeds: a violation occurs where grass and/or weeds are allowed to exceed 12 inches. City of Fate Code of Ordinances (CoO) 14-196.
  • Landscape Maintenance: to permit any dead tree, rubbish, brush, and all other reasonably objectionable, unsightly or unsanitary matter of whatever nature to accumulate or be present upon any such a lot, tract or parcel of land. City of Fate Code of Ordinances (CoO) 14-197
  • Junked Vehicle: a self-propelled vehicle that has an expired registration or inspection and is wrecked, dismantled, partially dismantled, and has remained inoperable in excess of thirty days on private property. City of Fate Code of Ordinances (CoO) 14-42.
  • 48 Hour Parking: an unattended vehicle on private property without the consent of the owner or on public property or the right-of-way of a designated county, state or federal highway, or any city street, alley, or other city right-of-way within the city limits for more than 48 hours. City of Fate Code of Ordinances (CoO) 14-42.
  • Unauthorized/Oversized Vehicles: any commercial motor vehicle, truck-trailer, semi-trailer or combination thereof, boats or boat trailers, personal watercraft or personal watercraft trailers, all-terrain vehicles or all-terrain vehicle trailers, motor homes or recreational vehicles, manufactured homes or mobile homes, or any vehicle exceeding a gross weight of 8,500 pounds that is parked in any right-of-way of the city or parked to the extent that through traffic is blocked or impeded City of Fate Code of Ordinances (CoO) 28, Article II, Division 3.
  • Trash and Debris: property owners and tenants are responsible for keeping their property and easements free of trash and debris. City of Fate Code of Ordinances (CoO) 14-197.
  • Outside Storage: All items not intended to be outside 100% of the time shall be stored within an enclosed building out of public view. City of Fate Code of Ordinances (CoO) 14-169.
  • Brush, Rubbish and Dead Trees: to permit any dead tree, rubbish, brush, and all other reasonably objectionable, unsightly or unsanitary matter of whatever nature to accumulate or be present upon any such lot, tract or parcel of land. City of Fate Code of Ordinances (CoO) 14-197.
  • Prohibited Signs: bandit signs are temporary signs posted in esplanades, areas between the sidewalk and curb, overpasses, utility poles, light standards and traffic boxes are prohibited (CoO) 36-37 (11). No painting, constructing, erecting, remodeling, or relocating any sign without first obtaining a valid permit is prohibited. City of Fate Code of Ordinances (CoO) 36.
  • Road/Sidewalk Obstructions: to place any article or substance on any thoroughfare in such a manner to obstruct the free passage upon such thoroughfare. City of Fate Code of Ordinances (CoO) 14-132.
  • Visibility Obstruction: no tree, shrub, plant, sign, soil, fence, retaining wall, or other view obstruction having a height greater than two feet or less than seven within sight visibility triangle as defined by Section 38-167 (9) (b) – the areas of property on both sides of the intersection of an access way and a public right-of-way shall have a triangular visibility area with two sides of each triangle being ten feet in length from the point of the intersection. The areas of property located at a corner of an intersection of two or more public rights-of-way shall have a triangular visibility area with two sides of each triangle being 20 feet in length from the point of the intersection.   • Home Occupation: activity shall be clearly incidental and secondary to the use of premises for dwelling purposes. Home occupations shall not include barbershops, beauty shops, carpenters, electricians, or plumbers shops, radio shops, tinner’s shops, transfer or moving van offices, auto repairing, auto painting, furniture repairing, sign painting or any form of merchandising activity. No outside storage of items permitted. City of Fate Code of Ordinances (CoO) 40-4.
  • Pool Enclosures: every spa, hot tub, swimming pool, or excavation designed or intended to ultimately become a swimming pool, while under construction as well as after completion, shall be continuously protected by an enclosure. An enclosure shall be a fence, wall, or building not less than four (4) feet in height with no opening, holes, or gaps larger than four (4) inches in diameter. Gates and doors opening directly into such enclosure shall be equipped with self-closing and self-latching devices and shall be attached to the gate or door not less than thirty-six (36) inches above the grade or the floor.   • Working without Permit: it is unlawful for any person to perform, authorize, direct, or supervise construction without a valid permit issued. Each day the violation(s) continues shall constitute a separate offense. City of Fate Code of Ordinances (CoO) Section 38-11.
